Terms of Service

These Terms of Service ("Terms") govern your use of the website manmohandev.online and the services provided by ManmohanDev, operated by Manmohan Singh ("we", "us", or "our"). By accessing this website or engaging our services, you agree to be bound by these Terms.

Please read these Terms carefully before placing any order or engaging us for any service. If you do not agree to these Terms, please do not use this website or our services.

1. Services Offered

ManmohanDev provides the following services to clients across India:

• Custom website development (PHP, WordPress, Shopify)
• Web design and UI/UX design
• Search Engine Optimization (SEO)
• Digital marketing (Google Ads, Meta Ads)
• Logo design and brand identity
• Video editing and social media management

All services are provided on a project or monthly retainer basis as agreed in the individual project proposal or service agreement.

2. Project Agreements and Proposals

Before any work begins, we will provide a detailed proposal outlining:

• Scope of work and deliverables
• Project timeline and milestones
• Pricing and payment schedule
• Revision policy

Work commences only after the proposal is accepted and the initial payment (advance) is received. The proposal constitutes a binding agreement between the client and ManmohanDev upon acceptance.

3. Payment Terms

Our standard payment schedule is as follows:

• 50% advance required before project commencement.
• 50% final payment due upon project completion, before final files or website access are transferred.
• For larger projects, a milestone-based payment schedule may be used as defined in the project proposal.
• Monthly services (SEO, social media, maintenance) are billed monthly in advance.

Payments are accepted via bank transfer (IMPS/NEFT/RTGS), UPI, or Razorpay. Invoices are provided for all payments.

Late payments: If a payment is delayed by more than 7 days beyond the due date without prior communication, we reserve the right to pause work on the project until payment is received.

4. Revisions and Scope Changes

Each project proposal includes a specified number of revision rounds. A revision is defined as a reasonable change or correction within the original agreed scope of work.

Additional revisions beyond the included number, or scope changes that significantly expand the original requirements, may be charged at ₹500–₹2,000 per hour depending on the nature of the change. Any scope changes will be discussed and agreed upon before additional billing is applied.

5. Intellectual Property and Ownership

Upon receipt of full final payment, the client receives full ownership of all deliverables specific to their project — including website design files, code, logo files, and brand materials created specifically for that project.

ManmohanDev retains the right to:

• Display completed work in our portfolio unless the client requests confidentiality in writing.
• Retain and reuse any general-purpose code, templates, or frameworks used in development that are not specific to the client's brand.

Third-party assets (stock images, fonts, plugins) remain subject to their respective licenses. The client is responsible for obtaining appropriate licenses for any third-party assets they specifically request.

6. Client Responsibilities

For the successful completion of any project, the client is responsible for:

• Providing all necessary content (text, images, videos, logos) in a timely manner as requested.
• Reviewing and providing feedback on deliverables within the agreed timeline.
• Ensuring that any content provided does not infringe on third-party intellectual property rights.
• Making timely payments according to the agreed schedule.

Delays caused by the client's failure to provide content or feedback may result in project timeline extensions without penalty to ManmohanDev.

7. Cancellation Policy

If a client wishes to cancel a project after work has commenced:

• The advance payment is non-refundable as it covers initial planning, research, and commenced work.
• Any work completed up to the point of cancellation will be billed at the agreed project rate on a pro-rata basis.
• All deliverables completed and paid for will be transferred to the client upon cancellation.

For monthly retainer services (SEO, social media, etc.), cancellations must be provided with 15 days written notice before the next billing cycle.

8. Limitation of Liability

ManmohanDev's liability in any dispute related to services provided is limited to the total amount paid by the client for those specific services. We are not liable for:

• Indirect or consequential losses including loss of business, revenue, or profit.
• Losses caused by third-party services (hosting providers, payment gateways, social media platforms).
• Losses due to client's failure to maintain software updates, backups, or security configurations after project handover.
• Specific search engine rankings — while we use best-practice SEO, no SEO provider can guarantee specific Google rankings.

9. Confidentiality

Both parties agree to keep confidential any proprietary business information shared during the course of the project. ManmohanDev will not share client business information, project details, or any sensitive data with third parties without written consent, except as required by law.

10. Website Usage Terms

By using manmohandev.online, you agree that:

• You will not use the website for any unlawful purpose.
• You will not attempt to gain unauthorized access to any part of the website or its systems.
• You will not copy, reproduce, or republish content from this website without prior written permission.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any disputes arising from these Terms or our services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be subject to the jurisdiction of courts in Rajasthan, India.

12. Changes to These Terms

We reserve the right to update these Terms at any time. Changes will be effective upon posting the updated Terms on this page with a revised "Last updated" date. Continued use of our services after changes constitutes acceptance of the new Terms.
